Recover Loss of Profits

Restricted customer access to your premises, as a direct result of utility road works, is resulting in significant loss of trade for your business. Unless these losses are rigorously pursued via the relevant utility company, they will remain forfeited forever.

The utility company will seek to both limit their liability and reduce as much as possible any claim for losses.

Our expertise lies in the maximisation and negotiation of your losses, ensuring you receive the highest settlement possible. Our largest single claim recovery is in excess of £300k, for a boutique restaurant chain based in London (March 2021).

As well as acting for many independent businesses, we are retained on a national basis by the likes of:

Euro Garages, Timpson, ScrewFix, One-Stop Stores, Pavers Shoes, Dobbies Garden Centres, and many others…

TESTIMONIALS

WHAT PEOPLE SAY ABOUT US

Huge thanks to Steve for successfully completing a claim on our behalf, to Northern Gas Networks, after we lost a large amount of Christmas custom during a very lengthy spell of roadworks near our retail shop.  We supplied all our data to him, and he did the rest!  Without Steve, I doubt that we would have received any compensation at all, so we can’t thank him enough.  Even if you don’t think you fit their claim criteria, let Steve take a look and decide for you.

CASE STUDIES

The Shambles – Worcester

Severn Trent Water Roadworks

This busy city centre shopping street effectively became a building site for 3 months, which in turn dissuaded passing-trade from the area. We have successfully recovered losses for several well-known high-street businesses.

Utilising our excellent negotiation skills we have managed to increase loss settlements by in excess of +50% above the utilities recommended offer.

Cambridge Road/Preston New Road – Southport

United Utilities Roadworks

The effects of a collapsed sewer meant the closure of this busy junction. Our clients included a gift shop, florist and fish mongers, all of whom suffered loss in trade compounded further by the fact that the closure covered the peak-trading dates of Mothers Day and Easter holidays – something we negotiated strongly for on our clients behalf.

Peak/Seasonal trading is a crucial factor for most retailers. We always ensure that this is evidenced and built in to the claim to ensure maximum recovery of losses.

Church Street West – Radcliffe, Manchester

United Utilities Roadworks

Our client opened for business one month prior to the beginning of the works and therefore had no trading history. We were able to successfully negotiate a recovery of losses based on a retrospective claim once the works had finished and the business had a chance to trade without interruption.

We have successfully negotiated settlements for many businesses that do not have the prerequisite trading history (2 – 3 years).

Micklegate – York

Yorkshire Water Roadworks

Instructed to manage loss of profit claims on behalf of 8 independent businesses. We successfully recovered maximum loss settlements for all claimants, some of whom were unaware they could claim altogether.
One of our clients was initially refused compensation owing to their premises being located outside of the affected area. We refuted the decision, presented strong evidential correlation and successfully negotiated an excellent settlement.

We are not prepared to accept refusal of settlement when we feel strongly that the claimants business has been causally affected and merits compensation.

Shinfield – Reading

Thames Water

A branch of the large garden centre chain Dobbies was affected by a 2 month road closure at the start of Spring 2018. A successfully negotiated claim that factored in the seasonality related aspect of garden centres was achieved. In addition to the garden centre itself, we achieved maximum settlements for other independent concessions within the garden centre.

Many large national companies are now instructing us on a weekly basis. They are impressed with our ability to coordinate claims across a branch network channelled through a central department (Property/Facilities/Estates) within Head Office.

Main Road – Bamforth

Severn Trent Water Roadworks

Our client is a community-run enterprise which had taken over this local pub/restaurant to save it from redevelopment. Being a tourist town the nature of the roadworks meant that trade suffered considerably, however due to various factors this was not straightforward case. Upon due diligence we managed to establish and evidence important pre-interruption correlations (reduced sales being due to building maintenance and other one-off events). This helped us to secure the maximum settlement possible on their behalf.

It is essential that any other important pre-interruption factors affecting sales are taken into account, and evidenced correctly.

Ovenden Road – Halifax

Northern Gas Networks Roadworks

Claiming compensation from the gas companies is notoriously problematic. The qualifying criteria within the prevailing legislation is extremely prohibitive and therefore difficult to exceed. We acted on behalf of a range of retailers affected by the works and successfully negotiated maximum settlements for all. Once more the peak/seasonality periods (Xmas, Valentines) was a major focus of the cases.

The gas regulations concerning compensation are fraught with ambiguity and obstacles. This however has never deterred us from pursuing the cause on our clients behalf. We have now built an enviable track-record of success in this area and are able to use our database of successful cases to establish precedent going forward.

Exeter Street – Exmouth

Wales & West Utilties

Our client actually contacted us only after their claim had already been rejected by the gas company. Upon review of the case we considered there to be a number of important factors that had not been properly considered. Upon resubmission of the case, along with lengthy negotiation, we managed to secure an excellent settlement for the claimant.

Utilities will naturally prefer it if you presented the claim yourself. This enables their own loss adjusters/surveyors to set-about countering your claim and leaving you with nowhere to turn.

Alston – Cumbria

United Utilities

The closure of the main thoroughfare (Front Street) caused hardship to retailers in this normally-busy tourist town. To compound matters further the road closure came into effect not long after the Beast from the East weather phenomenon which, for the highest market town in Britain, was particularly impactful. We undertook and negotiated maximum settlements on behalf of businesses.

We will always propose mitigation where applicable (e.g bad weather, refurbishment) in order to determine the strongest possible forecast.
